GENERAL TERMS AND CONDITIONS OF SALE
These General Terms and Conditions of Sale govern the sale and purchase of products through our website, "the-broken-arm.com".
Products purchased on the-broken-arm.com are sold by TBA CONCEPT SARL, a company registered in Paris, France under number 789.196.904, whose registered address is 12 rue Perrée - 75003 Paris, and whose intracommunity VAT number is FR77 789196904.
TBA CONCEPT offers products for sale exclusively to end consumers on the-broken-arm.com. Consequently, the-broken-arm.com reserves the right not to fulfil orders placed by persons wishing to purchase products for professional or business purposes.
These General Terms and Conditions of Sale may be amended at any time. Revised terms and conditions shall be effective on the date of their publication on the-broken-arm.com.
Each time an order is placed, the Buyer will be asked to confirm that he or she accepts the General Terms and Conditions of Sale in effect on that day. By sending the order form, the Buyer acknowledges and agrees to be bound fully by these General Terms and Conditions of Sale.
ARTICLE 1 - PRICE
The prices of our products are quoted in Euros. They include VAT and all other taxes but exclude processing and shipping costs. Prices are shown with their equivalent in other currencies ($, £, ¥) for information purposes only.
All orders must be paid for in Euros.
For shipments to all countries outside the European Union and France's overseas departments and territories, the price shown on the invoice sent to the Buyer will not include VAT or other taxes. Orders shipped to countries outside the European Union and France's overseas departments and territories may be subject to customs fees, local taxes, import duties and government taxes that are not the responsibility of the-broken-arm.com. If such additional charges are applicable, they must be borne by the Buyer who shall be solely responsible for filing all necessary returns and making all necessary payments to the relevant authorities and bodies in the country concerned.
Please note that depending on your order and country, you will be liable to pay local taxes and duties on receipt of your order, for which The Broken Arm cannot accept liability. The refusal of payment of such fees causes a full cancellation of the order. Transportation cost and custom clearance cost associated with a cancellation will be deducted from the amount refunded to you
the-broken-arm.com reserves the right to amend its prices at any time. However, products shall be invoiced on the basis of the prices in effect at the time the order is registered, subject to their availability.
ARTICLE 2 - AVAILABILITY
Our products are offered subject to availability of stocks.
the-broken-arm.com will inform the Buyer, by email or by telephone, as soon as possible after an order has been placed if any product ordered is not available in stock. If a product is not available, the order may be cancelled by the-broken-arm.com.
ARTICLE 3 – PAYMENT
The Buyer may use any of the following payment methods to pay for his/her order: :
- Debit or credit card (Visa, Mastercard, American Express, JCB)
- Paypal
- Alipay
All payments made on the the-broken-arm.com website are encrypted and secured by STRIPE.
ARTICLE 4 – DELIVERY
Products will be shipped by the-broken-arm.com to the delivery address given by the Buyer when placing his/her order.
Deliveries in France and international deliveries are made by DHL, UPS or another carrier of high repute.
A two-and-a-half to three-hour courier delivery service is available for deliveries to the inner Paris area. This option will be offered to you during the ordering process and is billed separately. This service will be provided by Coursier.fr or by another similar carrier of high repute.
Delivery costs are calculated automatically according to the delivery method selected and appear in the total amount to be paid. Delivery costs depend on the size of the order, the geographical location to which it is to be delivered, and the chosen delivery method.
A tracking number will be sent by email to the Buyer after checkout. The Buyer will then be able to track his/her parcel from dispatch through to delivery.
The Buyer must examine all goods at the time of delivery and ensure that any damage or shortages are recorded in writing on the carrier's delivery note. Claims must then be made by telephone or email to the-broken-arm.com's Customer Services team within 72 hours.
Deliveries are not prepared on weekends and French public holidays and not delivered on Sundays and other holidays.
Expect 1-2 more days on top of standard procedure during peak seasons, we appreciate your understanding. Shipping costs are in regards to private customer and for personal use only. Bulk orders may be charged with extra shipping costs.
ARTICLE 5 – RETURN POLICY
Items purchased on the-broken-arm.com are eligible for return under these conditions:
- Items must be returned by the client in their original unused condition with tags and packaging.
- The return request must be placed within fourteen (14) days after the date on which the order was received.
- No return will be offered against books, magazines, and items purchased at reduced price.
- The Broken Arm reserves the right to reject any returned items that do not meet the above requirements.
- If your return is rejected, you will be notified via email
- The Broken Arm will only process refunds, product exchange will not be accepted.
In order to place a return, please follow the instructions below:
- The client will be asked to fill out the return form in his order history and details.
- After the return request is confirmed by The Broken Arm, a return number will be created which the client needs to print and attach to the package.
- The Broken Arm does not cover return shipping cost.
- The Broken Arm can provide the return label, however the original shipping cost will not be refunded.
- The client is also free to use the shipping method of their choice, in this case, The Broken Arm will not be responsible for any shipping issue.

ARTICLE 6 – INTELLECTUAL PROPERTY
All intellectual property rights, including copyright, in the the-broken-arm.com website and its contents including text, comments, illustrations and graphics, are protected worldwide and are reserved. In accordance with France's Intellectual Property Code (Code de la Propriété Intellectuelle), the use of this website and its content is permitted for private purposes only.
Any other use of the the-broken-arm.com website or its content without the-broken-arm.com's prior consent will be viewed as an infringement of our rights and may result in legal action under intellectual property legislation and regulations.
ARTICLE 7 – LIABILITY
The products offered for sale comply with current French legislation and regulations. Buyers in other countries are responsible for requesting information from their local authorities about importing or using the products ordered.
ARTICLE 8 – PERSONAL DATA
The Buyer is informed that all personal data and information collected when he or she places orders is handled by the-broken-arm.com solely for the purposes of processing said orders. It may not under any circumstances be used for any other purpose.
The personal data stored by the-broken-arm.com to meet order processing and tracking needs is kept secure by the-broken-arm.com.
The Buyer may refer any concerns about the processing of his/her personal data directly to the-broken-arm.com.
ARTICLE 9 – GOVERNING LAW / DISPUTES
These general terms and conditions shall be governed by and construed in accordance with the laws of France. Any dispute(s) shall be subject to the exclusive jurisdiction of the courts within the jurisdiction of the Paris Court of Appeal.
